Acceptance of Terms
By booking a service with CAVA, you (“Client”) acknowledge that you have read, understood, and agreed to these Terms and Conditions in full. This agreement establishes the legal relationship between CAVA and the Client, outlining the obligations, limitations, and expectations of both parties.
1. Binding Agreement
By scheduling an appointment, making a payment, or using any of CAVA’s services, the Client agrees to be bound by these terms. If the Client does not agree to any part of this agreement, they must refrain from booking or using CAVA’s services.
2. Updates & Modifications
CAVA reserves the right to update or modify these terms at any time without prior notice. The most recent version will always be available on our website. Continued use of CAVA’s services after any modifications constitutes acceptance of the updated terms.
3. Legal Standing & Authority
The Client affirms that they are legally authorized to book services on behalf of themselves or their organization and that they are at least 18 years old. If booking for a third party, the Client is responsible for ensuring that all involved parties are aware of and agree to these terms.
4. Electronic Consent
By proceeding with a booking, the Client consents to the electronic execution of this agreement, waiving the need for a physical signature. This electronic acceptance is legally binding and holds the same weight as a signed contract.
Terms And Conditions
1. Copyright Policy
1.1 Basic License
1.1.1 Permitted Uses:
Listing property on MLS and real estate websites.
Social media and digital ads for property promotion.
Use by the original client (agent or brokerage) for active listings.
1.1.2 Prohibited Uses:
Use after the property is sold, rented, or off the market.
Transfer, resale, or licensing to third parties (builders, designers, etc.).
Editing beyond basic cropping or resizing.
1.1.3 License Duration:
Expires when the property is no longer on the market.
1.2 Extended License (Included with Matterport Virtual Tour Services)
1.2.1 Permitted Uses:
Agent/brokerage branding (portfolio, website, self-promotion).
Use by third parties (builders, designers, stagers) with written approval.
Minor modifications (adding logos, text overlays, filters).
1.2.2 Prohibited Uses:
Resale or sub-licensing of media.
Use in commercial advertising unrelated to real estate.
1.2.3 Additional Fee Applies:

1.3 Buyout License (Included with Photography, Videography, Virtual Staging Services)
1.3.1 Permitted Uses:
Unlimited commercial and marketing use.
Full modification, resale, and sublicensing rights.
No restrictions on duration or purpose.
1.3.2 Prohibited Uses:
None (client receives full ownership).
1.3.3 Significant Additional Fee Applies:

1.4 Company Usage Rights (If Buyout Occurs)
When a Buyout License is purchased, CAVA reserves the right to:
Showcase the work on CAVA’s website, portfolio, and case studies.
Feature the work in advertisements, social media, brochures, and other marketing materials.
Submit the work for industry awards, trade publications, and professional showcases.
Use the work for internal training, presentations, and workshops.
Display the work in client consultations and sales presentations.
Feature the work at real estate expos, conferences, or trade shows.
1.4.1 Exclusion Option:
Clients may request in writing to exclude their purchased media from CAVA’s promotional use.
1.4.2 Significant Additional Fee Applies:

1.5 Copyright & Unauthorized Use
Any use beyond the purchased license is a copyright violation.
The Company reserves the right to issue takedown notices, invoice for unauthorized use, or take legal action.
2. Payment, Refund, and Cancellation Policy
2.1 Payment Policy
2.1.1 Payment Terms:
Payment is due upon media delivery unless otherwise agreed.
If payment is not received within 3 days, a 10% late fee will be applied.
An additional 1.3% per day will be applied for each additional day payment is not received.
Payments are considered overdue after 7 days, and media may be withheld until full payment is received.
2.1.2 Accepted Payment Methods:
Payments must be made via Squarespace Checkout using credit/debit cards or digital payment methods.
Cash payments may be accepted if agreed upon in advance.
2.1.3 Late & Non-Payment Consequences:
After 7 days of non-payment, future bookings may require prepayment.
Repeated late payments may result in account restrictions or refusal of service.
2.2 Refund Policy
2.2.1 No Refunds on Completed Services:
Once media is delivered, all sales are final.
2.2.2 Refund Eligibility:
Refunds are only available under the following conditions:
Cancellations made within the allowed timeframe (see below).
If CAVA is unable to fulfill a scheduled appointment, a full refund will be issued.
2.2.3 Refunds Are Not Provided For:
Cancellations outside the allowed timeframe.
Client dissatisfaction due to property condition, staging, or weather unless the service was not performed as agreed.
2.3 Cancellation & Rescheduling Policy
2.3.1 Cancellation & Rescheduling Fees:
More than 24 hours before the appointment: No charge.
Between 24 and 12 hours before the appointment: $45 fee or reschedule at no additional cost.
Less than 12 hours before the appointment: $45 cancellation fee, even if rescheduled.
2.3.2 Rescheduling Policy:
One free reschedule is allowed if requested 24-12 hours before the appointment.
Additional reschedules beyond the first change incur a $30 fee per change.
2.3.3 Weather-Related Cancellations:
Outdoor shoots (including aerial/drone services) may be rescheduled due to severe weather at no charge.
2.3.4 No-Show Policy:
Late Arrival (Client/Agent): A $25 fee applies if the client or agent is more than 15 minutes late.
Delays exceeding 30 minutes:
CAVA reserves the right to terminate services.
If permitted, the session may be rescheduled with a $80 fee.
If the property is inaccessible or the client is a no-show:
The full booking fee plus an additional $80 charge will apply.
3. Default Payments Policy
CAVA reserves the right to withhold services or decline future services if there are outstanding unpaid balances.
Failure to remit payment for completed services may result in legal action, including additional costs for collection efforts.
4. Travel & Additional Fees Policy
4.1 Travel Fees
Service Area: CAVA provides real estate media services within a 75-mile radius of San Antonio, TX at no additional cost.
Extended Travel: A travel fee of $0.87 per additional mile (round trip) will be applied for locations beyond 75 miles.
Multi-Property Bookings: If multiple properties are scheduled within a 10-mile radius, only one travel fee will be charged.
5. Urgent & Rush Fees Policy
5.1 Standard Turnaround Times
Photos: 24-48 hours.
Videos: 48-72 hours.
5.2 Rush Photo Editing
Expedited Delivery: May be available within 12 hours.
Additional Fee: $75 per rush edit.
6. Rescheduling & Late Arrival Fees
6.1 Rescheduling Fees
One free reschedule is allowed if requested 24-12 hours before the appointment.
Additional reschedules beyond the first change incur a $30 fee per change.
6.2 Late Arrival (Client/Agent)
If the client or agent is more than 15 minutes late, a $25 fee applies.
6.3 Delays Exceeding 30 Minutes
CAVA reserves the right to terminate the services (subject to no-show and cancellation fees).
If permitted, the session may be rescheduled with an additional $75 fee.
7. Photo-Ready Policy
7.1 Property Preparation Responsibilities
Clients are responsible for ensuring the property is photo-ready before the scheduled session.
7.2 Requirements for a Photo-Ready Property
Clean & Staged: Ensure furniture is arranged properly and spaces are tidy.
Lighting: Ensure sufficient lighting or make arrangements in advance for additional lighting.
Pet Items: Remove pet-related items such as bowls, toys, and bedding. Pets should be secured off-site or in non-featured areas.
Repairs & Maintenance: Ensure any visible repairs (e.g., holes in walls, broken fixtures) are completed prior to the session.
7.3 Scheduling & Timing
The photographer will arrive at the scheduled time.
If the property is not ready or accessible, the session may be rescheduled, and additional fees may apply.
Late Arrivals: Delays may result in reduced session time or additional charges.
7.4 Property Access Requirements
The client, agent, or authorized representative must provide property access at the scheduled time.
Ensure doors are unlocked and areas requiring photos are unobstructed.
7.5 Assistance with Property Securing
CAVA team members can assist with turning off lights and ensuring the property is properly closed after the session.
However, CAVA is not responsible for fully securing the property after the shoot.
8. Matterport 3D Scan Policy
8.1 3D Virtual Tour Hosting
Each Matterport tour includes 3 months of active hosting at no additional cost.
After 3 months, hosting can be extended for $15 per additional month.
Inactive Tours: If hosting expires and is not extended, the virtual tour will be deactivated and removed.
8.2 Licensing & Usage
Extended License: Clients receive an extended-use license, allowing them to use the 3D tour for marketing and real estate listings indefinitely.
Non-Transferable: The tour cannot be transferred, resold, or used outside its intended purpose unless a Buyout License is purchased.
8.3 Buyout License & Self-Hosting
Full Ownership: Clients may purchase a Buyout License for $75, granting them complete control over the tour.
Transfer & Self-Hosting:
After purchasing the buyout, clients can transfer and self-host the tour by following the official Matterport transfer process.
No Additional Hosting Fees: Once transferred, CAVA no longer manages or charges for hosting.
8.4 Questions or Changes?
Contact us for inquiries regarding hosting extensions, licensing, or buyout options.
9. Liability & Damage Policy
9.1 General Liability Waiver
Service Risks: CAVA takes every precaution to perform media services safely, but clients assume all risks associated with filming, photography, and drone operations.
Property Condition: CAVA is not responsible for unfavorable media results due to property conditions (e.g., lighting, clutter, staging).
Hazardous Environments: If a property is deemed unsafe, CAVA reserves the right to refuse service or reschedule.
9.2 Drone Liability & Compliance
FAA Regulations: All drone flights comply with FAA Part 107 regulations, and flights may be canceled due to restricted airspace or unsafe weather conditions.
Property Permissions: The client is responsible for ensuring that drone flights are permitted at the location (e.g., HOA restrictions, private property rules).
Rescheduling Policy: If weather conditions are unsafe or a Temporary Flight Restriction (TFR) is in effect, the drone session may be rescheduled at no additional cost.
9.3 Damage Policy
Equipment Handling: CAVA team members are trained to operate equipment safely. However, CAVA is not responsible for accidental damage caused by third parties (e.g., pets, children, clients, or property occupants).
Pre-Existing Damage: CAVA will document any visible damage at the start of a session and is not responsible for pre-existing conditions.
Liability Limits: If accidental damage is caused by CAVA staff, liability is limited to a maximum of $500 for repair or replacement.
10. Virtual Services Policy
10.1 Nature of AI-Generated Images
CAVA utilizes third-party AI-powered virtual staging, touring and redesign platforms to create enhanced real estate images.
These AI-generated images are not photographs of the actual property and should not be interpreted as an exact representation of the property’s physical state.
10.2 No Guarantee of Accuracy or Physical Representation
AI-generated staging and redesigns are conceptual and do not reflect real, existing furniture, décor, or structural modifications.
Colors, materials, lighting, spatial proportions, and textures may appear differently in the AI-generated image compared to reality.
10.3 Limitations of Liability & Indemnification
CAVA is not responsible for any misinterpretation, error, omission, or inaccuracy in the AI-generated images.
CAVA is not affiliated with, nor does it control or guarantee, the accuracy of third-party AI-generated results.
10.4 Buyer & Seller Responsibilities
Prospective buyers and sellers must not rely on AI-generated visuals as a sole basis for evaluating a property’s condition.
Clients must disclose that virtual staging and redesign are artistic representations and do not reflect real-world conditions.
10.5 Client Acknowledgment & Agreement
By utilizing CAVA’s virtual staging, touring, and redesign services, the client agrees to the terms outlined in this disclaimer.
11. Image-to-Video AI Service Terms and Conditions
11.1. Service Overview
CAVA provides an AI-powered image-to-video service that transforms static images into animated video content.
After the AI processes the video, CAVA refines the final result by editing transitions, cuts, and copywriting to enhance the overall presentation.
This service is intended for marketing, visualization, and creative purposes only and does not guarantee an exact representation of real-world motion, quality, or details.
11.2. AI-Generated Content & Post-Editing
AI-generated videos are first processed through automated software and then manually edited by CAVA to adjust transitions, pacing, and text elements.
While CAVA ensures a polished final result, the core animation, motion, and object rendering remain AI-generated and may have inherent imperfections.
11.3. No Guarantee of Accuracy or Authenticity
AI-generated content is inherently unpredictable, and results may vary.
The final video may include:
Alterations in lighting, object details, textures, or proportions.
Inconsistencies in movement, animation, or depth perception.
Unintended distortions or artifacts caused by AI processing.
CAVA’s post-editing process does not alter AI-rendered animations, and we do not guarantee realism or accuracy in AI-generated motion.
11.4. Limitations of Liability & Indemnification
CAVA is not responsible for:
Any inaccuracies, distortions, or unintended effects caused by AI processing.
Client dissatisfaction with AI-rendered visuals.
Any legal or financial consequences arising from the use of AI-generated content.
CAVA’s post-editing is limited to transitions, pacing, and copywriting and does not include manual frame-by-frame animation corrections.
By using this service, clients acknowledge the limitations of AI technology and agree that results may vary.
Clients assume full responsibility for the use, distribution, and interpretation of AI-generated videos.
11.5. Client Responsibilities
Clients must review the final AI-generated video before use to ensure it meets their needs.
If AI-generated videos are used for marketing, advertising, or public distribution, clients are responsible for disclosing that the content has been digitally enhanced.
Clients agree to not hold CAVA accountable for any AI-related inaccuracies or unexpected results.
11.6. No Refund Policy
Due to the automated nature of AI processing and the custom manual editing applied by CAVA, all sales are final.
Refunds will not be provided based on:
Dissatisfaction with AI-generated results.
Variations between the original image and the generated video.
Perceived inaccuracies in animation, object rendering, or movement.
11.7. AI Processing & Third-Party Software Disclaimer
AI-generated videos are created using third-party AI software, and CAVA has limited control over how the AI processes images.
CAVA makes no guarantees regarding:
The accuracy, realism, or consistency of AI-generated content.
The functionality, reliability, or availability of the AI service.
Clients acknowledge that results are generated programmatically and that variations in output are expected.
11.8. Client Acknowledgment & Agreement
By using CAVA’s Image-to-Video AI Service, the client:
Acknowledges that AI-generated content may not always meet expectations.
Understands that while CAVA provides post-editing, the core animation is AI-generated and may have inherent imperfections.
Agrees that CAVA is not liable for any distortions, inaccuracies, or unexpected AI-rendered effects.
Accepts that all transactions for AI-generated videos are non-refundable.
12. Consent to Receive Text Messages
12.1 By using CAVA’s services, the client agrees to receive SMS (text) messages from CAVA regarding:
12.1.1 Booking confirmations and reminders.
12.1.2. Service updates and order status.
12.1.3 Payment notifications and follow-ups.
12.1.4 Promotional offers, discounts, and marketing messages (optional).
12.2 Clients can opt out of promotional text messages at any time by replying STOP to any message.
12.2.1 Standard message and data rates may apply as per the client’s mobile carrier plan.
12.2.2. Message frequency may vary based on client interactions and service needs.
12.2.3. CAVA is not responsible for any delayed or undelivered messages due to carrier issues.
